AI & Automation

AI and automation systems may produce incomplete or inaccurate outputs, fail, or behave unexpectedly. Users remain responsible for operational decisions, verification, and human review where needed.

Cookies & Tracking

Marathon may use cookies, session tracking, analytics, embedded scripts, diagnostic tools, and performance monitoring to improve systems, workflows, site performance, and troubleshooting.

Communications

Users may receive service, support, scheduling, billing, workflow, operational, security, and permitted marketing communications.

Data Sharing

Information may be shared with providers needed to operate services, including hosting, cloud, payment, support, automation, AI, communication, contractor, and legal providers. Marathon does not sell personal information.

Third-Party Platforms

Marathon may use or integrate systems such as Zoho, Google, Microsoft, OpenAI, QuickBooks, Duda, telecom providers, hosting providers, payment providers, APIs, and cloud infrastructure. Third-party services operate under their own policies.

Security & Retention

Marathon uses reasonable technical and operational measures to protect information. No system is completely secure. Information may be retained for service delivery, support history, legal compliance, security, backup, and recovery purposes.

Business Use Only

Marathon services are intended only for businesses, business representatives, and individuals acting in a professional or commercial capacity. Services are not directed toward minors or personal consumer use.

Terms of Service

Marathon may provide automation implementation, workflow design, systems integration, AI-assisted systems, consulting, managed services, support, website services, phone system services, infrastructure coordination, and digital systems management.

No Guarantee

Marathon does not guarantee revenue increases, operational improvements, cost reductions, AI accuracy, continuous uptime, error-free systems, compatibility between all systems, or third-party platform reliability.

User Responsibilities

Users are responsible for accurate information, account security, lawful use, reviewing AI outputs, reviewing workflow behavior, maintaining licenses, cooperating during implementation, and maintaining operational oversight.

Payments & Billing

Users agree to pay applicable consultation, implementation, support, managed service, hardware, usage, subscription, tax, and related costs. Late payment may result in suspension, workflow interruption, loss of support, fees, and collection activity.

Service Availability

Marathon does not guarantee uninterrupted availability. Services may be interrupted by maintenance, outages, vendor failures, infrastructure issues, security incidents, third-party failures, or platform changes.

Liability

To the maximum extent permitted by law, Marathon is not liable for indirect damages, consequential damages, lost profits, lost revenue, lost data, operational disruption, reputation damage, downtime, AI errors, automation failures, or integration failures.

Intellectual Property

Marathon retains ownership of internal systems, proprietary workflows, frameworks, templates, documentation, branding, infrastructure, operational methods, and internal software components unless otherwise agreed in writing.

Confidentiality

Both parties agree to use reasonable efforts to protect confidential information, excluding information that is public, independently developed, lawfully obtained elsewhere, or required to be disclosed by law.

Termination

Marathon may suspend or terminate services for non-payment, abuse, security concerns, illegal activity, operational risk, or violation of these Policies & Terms. Users may discontinue services subject to outstanding obligations.

Changes

Marathon may update these Policies & Terms at any time. Updated versions become effective when posted. Continued use of services constitutes acceptance.

Users acknowledge that AI systems may produce inaccurate or incomplete outputs, automation systems may fail or behave unexpectedly, human review may be required, and users remain responsible for operational decisions and verification.

Limitation of Liability

To the maximum extent permitted by law, Marathon is not liable for indirect damages, consequential damages, lost profits, lost revenue, lost data, operational disruption, reputation damage, downtime, AI errors, automation failures, or integration failures.

Maximum liability shall not exceed amounts paid to Marathon for applicable services during the prior three months.

Intellectual Property

Marathon retains ownership of internal systems, proprietary workflows, frameworks, templates, documentation, branding, infrastructure, operational methods, and internal software components unless otherwise agreed in writing.

Users retain ownership of their business data and business content.

Confidentiality

Termination & Changes
